Rule 9
Arrangements for taking or giving aircraft on rent (lease)
:
(1) In case the air service operating organization that has received permission and certificate according to rule 4 needs to lease or give an aircraft, it must submit the necessary details in the format mentioned in the annex and manual and attach the fee as mentioned in Schedule-1 to the Director General.< br> (2) When submitting the application according to sub-rule (1), the copies of the agreement regarding renting or giving the aircraft should also be included.
(3) In case of changing the operation of the leased or given aircraft in accordance with this rule, the application shall be submitted to the Director General with the fee mentioned in Schedule-1 attached.
(4) If an application is made according to sub-rules (1) and (3), the Director General shall give permission to rent or give the aircraft and to change the owner and manager of the rented aircraft after conducting the necessary investigation. While giving permission in this way, the director general can also specify other necessary conditions as well as changes in the terms of the contract. However, if it is necessary to take the operational and technical responsibility of the aircraft of the country that rents or gives the aircraft, such permission will be given only after mutual agreement between the civil aviation authorities of the respective countries.
(5) Notwithstanding anything written in sub-rule (4), such permission shall not be granted until it is proved that the amount due to be paid to the Government of Nepal and the Authority has been paid.
(6) According to this rule, if there are any additions or amendments to the contract or any other actions taken by the lessee in connection with the lease, the related documents shall also be submitted.
